Less than 5mm long, I have no idea of the family (less yet the genus and sp. Pfft).

i think it is not possible to say much more here.

This fly is pretty common in Corylus avellana Wink I mean the genus of the fly. Wink

I think too much pale on the legs for minutus.

minutus and australominutus can be this pale on legs.
Can you see a slight apico-ventral rim on the front tibia?
Side of scutum looks very shiny in the photo and one would expect it to be a bit dulled in minutus (which has a rather clear median shining line on the scutum)

I think the mesonotum is too glossy over-all, especially in the dorsal view.
