I think it is Opomyza germinationis. Is it possible to confirm that?

23 Sept 2007, France (near Paris, in a little garden)
size : 6-7 mm (not sure)

Could you upload your top photo to the gallery? - it shows the markings on the thoracic dorsum nicely, and Gerard's photos in the gallery do not, although they show the wing and other characters beautifully.
