I am including a side view. Neither shot is sharp, but all I got on a windy day with the plant blowing and then the fly was gone. As I don't recgonize the family I am curious of this at least.

It may be a species of
Trichonta
of the fungus gnats (Mycetophilidae).

all the more regret that I couldn't get a good shot as it would be a new family for me.
